Good relations between Russia and Turkey became strained when Russia's SU-24-M fighter jet was shot down by Turkey on 24 November 2015 in Syria. It was the first time a NATO country had shot down a Russian jet in over 63 years. Although a year after this incident, the relations were restored by the leaders of the two states, Erdogan and Putin, it is still important to investigate the jet incident more deeply and within the framework of international law in order to prevent future violations of this nature. As a matter of fact, Russia's invasion of Ukraine on 24 February 2022 reveals the necessity of this investigation. The aim of this study is to examine the downing of the Russian jet by Turkey within the realm of compliance with international law. In this regard, first of all, information will be provided about the status of the airspace. Then, compatibility of Turkey's downing of the Russian jet with international law is discussed.

Militia groups have only recently started to attract scholarly attention in the literature on internal conflicts. This attention is mostly focused on either the causes of their emergence or their functions and performance during the conflict. The role of militia groups in post-conflict processes, however, has not been adequately addressed. This article intends to fill this gap by analyzing the case of village guards, a type of pro-government militia system in Turkey, based on qualitative evidence from field research. While the dominant narrative in the literature identifies militia groups as spoilers in peace processes, the article shows that militias do not act as spoilers under certain conditions. In the case of the village guard system in Turkey, the permanent integration of militias into the state's regular military apparatus prevented militia groups from acting as spoilers. It then argues that the permanent integration of wartime militia systems is a consequence of two factors: militia networking and a lack of comprehensive peace-building structures.

Cybercrime or the computer-related crime is the most widespread form of transnational crime, which is in its social and economic characteristics significantly different from traditional and organized crime. Cyberspace offers countless opportunities for economic development, social interaction, and political cooperation, but also provides tools for illegal surveillance, personal data collection, influencing democratic processes, committing crimes, and exchanging numerous ways and methods of warfare. This paper provides an overview of legal documents in the Republic of Serbia related to information security, data security, and deviant behavior in cyberspace, with special emphasis on the analysis of the Strategy for Information Society Development and Information Security in the Republic of Serbia for 2021-2026. Using the criminological approach, this paper focuses on legislation concerning existing criminal offenses related to cybercrime and various forms of other criminal activities, but also on the international cooperation that Serbia achieves in the field of information and cyber security.; Siber suç veya bilgisayarla ilgili suç, sosyal ve ekonomik özellikleri bakımından geleneksel ve organize suçlardan önemli ölçüde farklı olan, sınıraşan suçun en yaygın biçimidir. Siber uzay, ekonomik kalkınma, sosyal etkileşim ve siyasi işbirliği için sayısız fırsat sunar, ancak aynı zamanda yasadışı gözetim, kişisel veri toplama, demokratik süreçleri etkileme, suç işleme ve çeşitli savaş yöntemleri ve yöntemlerinin değiş tokuş edilmesi için araçlar sağlar. Bu makale, 2021-2026 için Sırbistan Cumhuriyeti’nde Bilgi Toplumu Geliştirme ve Bilgi Güvenliği Stratejisinin analizine özel vurgu yaparak, siber uzayda bilgi güvenliği, veri güvenliği ve sapkın davranışlarla ilgili Sırbistan Cumhuriyeti’ndeki yasal belgelere genel bir bakış sunmaktadır. Kriminolojik yaklaşımı kullanan bu çalışma, siber suçlar ve çeşitli diğer suç faaliyetleriyle ilgili mevcut cezai suçlarla ilgili mevzuata ve aynı zamanda Sırbistan'ın bilgi ve siber güvenlik alanında gerçekleştirdiği uluslararası işbirliğine odaklanmaktadır.

Bu çalışma, 6284 sayılı Ailenin Korunması ve Kadına Karşı Şiddetin Önlenmesine Dair Kanun’un birinci derece mahkemeleri tarafından uygulanmasını ve buna yönelik Anayasa Mahkemesi’nin değerlendirmelerini kapsayan kararların bir analizidir. Bu analiz, Anayasa Mahkemesi’ne 6284 sayılı Kanun m 4 ve m 5 kapsamında haklarında çıkan kararlara yapılan bireysel başvurulara odaklanmaktadır. Bu paralelde çalışma, Anayasa Mahkemesi tarafından “kişinin dokunulmazlığı, maddi ve manevi varlığı (Anayasa m 17)” ile “hak arama hürriyeti (Anayasa m 36, m 38/4)” kapsamında adil yargılanma hakkı ve gerekçeli karar hakkı açısından verilen ihlal kararlarının tespiti ve değerlendirmesi üzerinedir. Çalışmanın asıl çıkış noktası da olan husus; 6284 sayılı Kanun’un uygulanması aşamasındaki aksaklıklar sebebiyle Anayasa Mahkemesi’nin şiddet uygulayanın bireysel haklarının ihlal edildiğine karar vermesi ve bu sebepten şiddete uğradığını beyan eden kadının dolaylı olarak ortaya çıkan potansiyel mağduriyetidir. Bu paralelde çalışmada ilgili yasa yürürlüğe girdiği günden bugüne kadar kadına karşı şiddet dava sonuçlarına yönelik Anayasa Mahkemesi’ne yapılan bireysel başvurular Anayasa Mahkemesi’nin resmi sayfasından taranmıştır. Anayasa Mahkemesi’nin on bir (11) ihlal kararı verdiği tespit edilmiştir. Bu ihlal kararlarındaki gerekçeler analiz edilerek birinci derece mahkemelerinin verdiği kararlarda 6284 sayılı Kanun’un uygulanmasında hakimlerin meslek içi özelleştirilmiş eğitim almaları ve bunların da uluslararası düzeyde kadına karşı şiddet, ailenin korunması ve toplumsal cinsiyet konularını kapsamasının gerekliliği yönünde tespit ve öneriler sunulmuştur. Çalışmanın ilerleyen dönemde sayıca artabileceği düşünülen bireysel başvuruların değerlendirilmesinde yol gösterici bir referans olarak alınarak ilgili kanunun geliştirilmesine katkı sağlaması hedeflenmiştir.; This article is conducted regarding decisions of the Turkish Constitutional Court protecting the justifications of trial courts through Law No. 6284 on Protecting Familiy and Preventing Violence Against Women. The article focuses on individual applications to the Constitutional Court about the sentences within the scope of Articles 4 and 5 regarding Law No. 6284. Hence, the aim is to analyze the infringement decisions by considering personal inviolability, the material and moral circumstances of the individual (Art. 17), and freedom to claim rights through the right to a fair trial and the right to a reasonable decision (Art. 36; Art. 38/4) from the Constitutional Court. The starting point of this article is the indirect result of a potential aggrievement of women who declare having been subjected to violence, due to which the Constitutional Court makes decisions regarding the violation of the individual rights of the person who was declared to be the perpetrator of violence as a result of the problems implementing Law No. 6284. Thus, this study scans individual applications to the Constitutional Court regarding the results of cases of violence against women from the official page of the Constitutional Court since Law No. 6284’s enactment. The Constitutional Court is seen to have decided 11 times that Law No. 6284 had been violated. This article analyzes the reasons for these violation decisions and presents the assumptions and suggestions from the decisions of the first-instance courts in the direction of judges needing to receive specialized in-service training for implementing Law No. 6284. The study aims to contribute to the development of the relevant law by taking it as a referential guide for evaluating the individual applications that are believed will increase in number in the future.
